Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0088188), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Colonie Locomotive Shop discharges stormwater runoff from the site. Stormwater runoff is collected in basins and in the storm sewer system, routed to stormwater equalization lagoon and then through the oil water separator, where it discharges to the Kroma Kill, a class D water.

The following changes to the permit are proposed: - Permit pages have been updated based on current DEC guidance, format and nomenclature. Contact names, addresses and phone numbers have been updated. - A permit limits, levels and monitoring definitions page has been added. - Total suspended action level, and settleable solids monthly limit have been added. - A schedule of compliance has been added. - A water flow diagram has been added, and the site map has been updated.

Availability of Application Documents:

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 25, 2011.

Project Description:

The applicant proposes to conduct a stream restoration project along the Batavia Kill for approximately 3,300 feet. The project is a component of the Shandaken Tunnel SPDES Permit and the NYC Filtration Avoidance Determination. The goal of the project is to address a chronic turbidity problem associated with long lengths of eroding stream bed and banks of the Batavia Kill. The project consists of re-alignment of the stream channel, installing geomorphically appropriate channel dimensions, instream structures (rock vanes, j-hook vanes), installing rock rip rap for stabilization. Bioengineering techniques include live willow stakings, fascines, potted trees and shrubs, and seeding with native riparian seed mix. The project is located south of State Route 23 west of the hamlet of Ashland.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
