Project Description:

The applicant proposes to reconstruct a 17'H deteriorating earthen embankment dam within the same footprint at the outlet of Elk Lake to The Branch. This is a Low Hazard Class A dam, ID#202-3452. The existing dam has a 19.3'W single spillway constructed of rock-filled wood cribbing, with a wooden deck bridge over top. The new earthen fill embankment dam will have concrete retaining walls on the upstream and downstream face covered with wood plank siding, 19' wide concrete spillway channel covered with wooden planks (crest elev. 1993.6'), a drain system to contain potential seepage, steel sheeting core wall to prevent seepage, and a low level outlet system to be controlled by a sluice gate (also to be used for dewatering), designed in accordance with DEC Dam Safety Regulations. The top of the dam embankment will remain at elevation 2,000'. A gravel road will be constructed on top of the dam, with a new bridge over the spillway. A cofferdam constructed for dewatering during construction will remain on the lake bed (top elev. 1992.5'). The shoreline immediately above and below the newly constructed dam will be stabilized with rock rip rap, as it exists currently.

The Department has prepared a draft permit and made a tentative determination to approve a modification of the existing Air Title V Facility permit for the Innovative/Fulton landfill to replace one (1) of the permitted existing G3520C IC engine-generator sets with one (1) new G3516C IC engine- generator set. In addition, they propose to incorporate applicable regulatory requirements for 40 CFR 63 subpart ZZZZ and 40 CFR 60 subpart JJJJ.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant has proposed to excavate approximately 55,000 cubic yards of sediment from a 7.3-acre section of the Mohawk River (Class A) and dispose of the spoil in the riparian upland, in support of the establishment of a proposed residential and recreational development known as the "Halfmoon Village and Yacht Club." The project also includes the construction of a 75-slip docking facility and an observation pier, the removal of Water Chestnut over a 13.4-acre adjacent area of the Mohawk River, and the establishment of a public park with a fishing pier and a canoe/kayak launch.
