Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0160814), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Town of Gorham Wastewater Treatment Plant has a design flow of 0.061 mgd. Treatment includes an oxidation ditch - the treatment process consists of an orbal oxidation unit with a central secondary clarifier and mechanical aeration disks on the perimeter of the track. Liquid sludge is collected in a sludge holding tank and hauled to the Canandaigua WWTP for ultimate disposal at landfill. Sludge is pumped twice a year. This facility has surface discharge to Flint Creek, a class A water.

The following changes to the permit are proposed: Information has been updated on page 1 and a standard permit definitions page has been added. Reduced the water quality based effluent limit for Ammonia. Mercury Minimization Plan requirements have been added. Discharge Notification Requirements have been added. A monitoring Locations page has been added. Recording, Reporting and Additional Monitoring requirements page has been updated.

Project Description:

The applicant proposes to develop and operate a new 45 acre surface sand and gravel mine located on the north side of Strong Road in the Town of West Bloomfield. The mine will operate as a traditional surface extraction of sand and gravel. Mining is not proposed for below the local water table. Excavation will be by mechanical equipment, standard for sand and gravel mining operations, including processing. Maximum processing rates for the screening and crushing operations will not exceed 150 tons per hour. The consumptive use of ground or surface water resources has not been proposed for this mining operation. No vehicle maintenance or service activities will be conducted at this site. Final reclamation will include the replacement of stockpiled topsoil and will create stabilized, revegetated open space. The reviewed Life-of-Mine (LOM) area for this proposal is 45 acres.

Project Description:

The Department has received an application to modify the SPDES permit for the above referenced facility located at 200 East Main Street in the Village of Macedon. This facility discharges stormwater runoff to the NYS Barge Canal, a class C waterbody. This modification includes a permit transfer as the facility is now owned by Pliant LLC and operates under the name Berry Plastics. The proposed modification will consolidate the SPDES permits for the former Tyco facility (NY0245992) and Pliant facilities (NY0000272 and NY0246042) that occupied the same building. These formerly separate facilities are now under single ownership. Pliant has isolated and redirected all process wastewater and non-contact cooling water discharges, therefore only a stormwater discharge remains from this facility. This proposed permit modification will also reduce flow and pH monitoring from 2/month to monthly and will reduce monitoring of settleable solids from 2/month to quarterly. Also, actions levels for total dissolved solids, chromium, copper, iron, lead, surfactants, zinc, ammonia, and BOD5 are proposed to be removed from the permit as there has been no exceedance of these levels for at least three years. Outfall 011 is also proposed to be removed from the permit as it has been plugged and is no longer used.

The Department has made a tentative determination to approve this modification. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
