The Department has received an application from the Town of Batavia to create the Wortendyke & Pike Road Water District and to take for use therein a supply of water up to 10,034 gallons per day from the City of Batavia and Monroe County Water Authority sources. The project includes the installation of 17,600 Linear Feet (LF) of water transmission main and 4,600 LF of 8 inch watermain and appurtenances along sections of Wortendyke Road (not covered by other permitted districts) to serve approximately 44 residences (Areas A, B, and C). The project involves crossing two tributaries of Tonowanda Creek and a crossing within the adjacent area of regulated wetland AX -7 (Area A only). Appropriate sedimentation and erosion controls will be employed to avoid contravention of water quality standards. The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

The Department has made a tentative determination to issue a modification to the SPDES permit held by Great Lakes Kraut Company a food processing facility located in Shortsville, NY. The permit authorizes discharge of process wastewater and boiler blowdown from Outfall 001 and contact cooling water from Outfall 004 to the Canandaigua Outlet; and stormwater from Outfalls 002 and 003 to a stormsewer to Canandaigua Outlet. The permittee can only discharge when the Outlet is above a flow rate of 100 cubic feet per second (cfs). The permittee has applied to discharge to the Outlet during flow rates of 60 cubic feet per second (cfs) from May to October and 35 cfs from November to April to allow the facility to discharge more frequently which will maximize the treatment capacity of the lagoon and address the odor problems at the facility. The modification includes many administrative updates, reductions in production-based effluent limits, and additional monitoring and effluent limits to assure water quality standards are met at lower receiving water flow rates. Changes to Outfall 001 include the addition of monitoring requirements including Total Kjeldahl Nitrogen (TKN), Total Dissolved Solids (TDS), Chlorine, and Temperature; seasonal Ultimate Oxygen Demand (UOD) limits; and a reduction of loading limits for Biological Oxygen Demand (BOD5) and Total Suspended Solids (TSS). Monitoring has been added to stormwater outfalls 002 and 003 for flow, pH, BOD5, TSS, TDS, Oil/Grease, and TKN. Monitoring has been added to Outfall 004 including TSS, TKN, and BOD5. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. The draft permit is available for review and comment at NYSDEC Region 8.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the above-referenced State Pollutant Discharge Elimination System (SPDES) permit (NY 0110531), pursuant to 750-1.18 and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). The Village's wastewater treatment facility has a surface discharge of 0.2 million gallons per day of treated sanitary effluent into the Chemung River, a Class C waterbody.

The following modifications to the permit are proposed: 1.) Add Total Nitrogen and Total Phosphorus monitoring as part of the Chesapeake Bay watershed program and 2.) Update permit to current document format.
