Project Description:

The applicant, the Town of Herkimer, proposes to establish and construct the West German Street Water District (as created by town resolution dated June 7, 2010). The project would result in the installation of a complete water supply and distribution system to serve the Town of Herkimer West German Street Water District. The project would require a taking of a supply of water in amounts up to 1,500 gpd annual average and 3,000 gpd maximum day from the existing water supply facilities of the village of Herkimer.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Construction of a wind-powered electrical generation facility consisting of 51 wind turbines and supporting infrastructure on approximately 60 acres within an approximate 7,600-acre project development area in the Towns of Cape Vincent and Lyme, Jefferson County. Construction activities will result in a total of approximately 0.32 acres of permanent fill impacts, and 1.95 acres of temporary impacts, to U.S. Army Corps of Engineers (USACE) jurisdictional wetlands. Approximately eleven overhead power poles will be placed in the adjacent areas of DEC Wetlands CV-1 and U-4, within an existing former railroad bed, as part of the transmission line to the Lyme substation. Project construction activities will also result in 50 linear feet of permanent impacts to USACE-jurisdictional streams. To mitigate permanent impacts to wetlands, adjacent areas and streams that result from project construction, wetlands will be created at a mitigation site at a 3:1 replacement ratio. The applicant is seeking an endangered and threatened species, Incidental Take Permit for the construction and operation the project. Species potentially impacted by direct or indirect take include Short-eared Owl, Upland Sandpiper, Henslow's Sparrow, Northern Harrier, and Indiana Bat. A permit allowing for annual direct take of one each of the four bird species is being sought by the applicant. Additionally, the applicant is proposing to mitigate permanent loss of 40.86 acres of habitat through managed conservation easements on 252 acres adjacent to the project. The applicant commits to a three year post construction monitoring study to determine direct impacts to birds and bats, displacement studies to determine effects of operation on grassland birds, and an adaptive management process to alter operations if impacts exceed permit thresholds. State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
