Project Description:

Applicant is proposing to construct 262 residential condominium units to be served by municipal sewer and water. Of those 262 units, 85 are located within the Ramapo River Recreational corridor and requires a permit pursuant to Article 15, Title 27 of the ECL (Wild, Scenic and Recreational Rivers Act). In addition a Stream disturbance/Section 401 Water Quality Certification is required for the 2 proposed crossing's of an unnamed tributary of the Ramapo River. The proposed crossings will result in approximately 1,800 square feet of fill. A Stormwater Pollution Prevention Plan (SWPPP) has been prepared for the project. The Town of Ramapo MS4 is responsible for reviewing and approving the SWPPP.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Ramapo Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0030767), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit. The facility has surface discharge to Watershed tributary 3 of Siscowet Reservoir, a class A water.

The Oakwood Sewage Treatment Plant has a design flow of 0.08 mgd. Current treatment includes influent screening, primary settling, flow equalization, rotating biological contactors, clarifiers, filtration, chlorination/decholorination, sand filters and reaeration. Sludge is stored on site for transport by a sludge hauler for land application or disposal.

The following changes to the permit are proposed: - Permit pages and conditions have been updated to reflect current permit language, department guidance, format and nomenclature. - Based on water quality assessment, the ammonia limit have been revised to a seasonal limit from 6/1 to 10/31. The existing limit will continue from 11/1 to 5/31. - A minimum dissolved oxygen limit has been included. - A Schedule of Compliance has been added and includes a short term monitoring program for copper, nickel, zinc, bromodichloromethane, bromoform and chloroform. - The Schedule of Compliance also requires sampling for mercury with analysis using EPA's method 1631. - A mercury minimization requirement has been added.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
