Project Description:

Decommissioning and removal of Lower Melzingah Dam (NYS Dam ID# 213-0523), a high hazard dam impounding Gordon's Brook (WIN H-92, Class B) to form Lower Melzingah Reservoir (WIN H-92-P330, Class C), and restoration of the Gordon's Brook stream channel. The dam is approximately 375 feet long and 36 feet high and is being breached because of its structurally deficient condition.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Beacon City Council

State Historic Preservation Act (SHPA) Determination:

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Dec 23, 2010.

Project Description:

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System (SPDES) permit (SPDES no. NY-0274828) for the surface discharge of 4,000 gallons per day (gpd) of sanitary wastewater to an unnamed tributary of Rhinebeck Kill (Class C) from a proposed 20,000 square foot commercial building. A wastewater treatment plant is to be constructed on site and the outfall pipe will traverse approximately 40 linear feet of federally regulated wetland to facilitate the discharge. A draft permit is available for inspection and comment at the DEC Region 3 office.
