Project Description:

The Department has prepared draft permits and made a tentative determination to approve the application to renew the facility's Title IV and Title V permits, and to modify the Title V permit. The permits will be renewed for 5 more years, and the Title V permit will be modified to include conditions recently promulgated under regulations 6 NYCRR Parts 243, 244, and 245. These regulations require facilities to obtain/possess at least as many 'allocations' of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. An 'allocation' is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency's (EPA's) recent "Clean Air Interstate Rule" (CAIR). The regulations are included in New York's ' State Implementation Plan' (SIP) which has been approved by EPA as required by the Clean Air Act of 1990.

The facility consists of two 185 MWe turbine/generator boiler sets operating on natural gas, #1, #2 or #6 fuel oils. The combustion turbines operate on either natural gas, or #1, or #2 fuel oils. In addition, an industrial steam boiler is maintained on site for building heat. In addition to pipeline natural gas, #1, #2 and #6 fuel oil, the steam turbine boilers can burn waste oil generated on and off site for energy recovery, and may incinerate citrosolv, a boiler cleaning solution, following boiler chemical cleaning. There are numerous tanks used for storing distillate, lubrication and/or electrical cable oils at this facility. Twelve combustion turbine-generators are maintained on site to meet system load demands.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The applicant proposes to remove clusters of Japanese knotweed by cutting and applying the herbicide, glyphosate. The disturbed area is proposed to be filled and re-graded as needed and replanted with native species. The proposed project is located within 100' of NYSDEC regulated tidal and freshwater wetlands at 520 Bay Pointe Drive in Moriches in the Town of Brookhaven, Suffok County Tax Map #0200-854-04-02.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

The applicant proposes to remove the remains of a dock, and construct a 4' by 400' elevated walkway and 4' by 50' dock at Jule Pond. A portion of the elevated walkway will traverse a NYSDEC regulated freshwater wetland (FWW#SA-14) before crossing over vegetated tidal wetlands associated with Jule Pond. The applicant also proposes to clean up an area of debris, remove a portion of existing lawn and replant with native plant species.
