The applicant proposes rehabilitation, reconfiguration and expansion of their existing docking facility, increasing their capacity by 80 boatslips (from 14 to 94 boatslips), within their underwater land grant area. The new docking facility will total approx. 26,090 SF, consisting of pile-anchored ADA accessible floating docks. The main docks range from 6-9' wide, finger docks range from 3-5'wide, with five gangways, and a 16'W x 200'L wave attenuator for one of the outer docks. The proposal also includes the following: replace approx. 1,255' of existing shoreline retaining wall structures with rock rip rap (~692'), stone wall (~224'), and bulkhead (~170') within the existing footprint; place approx. 13,536 CY of stone fill within and around four sunken barges to create expanded breakwaters; reuse of material excavated below the MHWL for the breakwaters; fill a marine railway (~2,660 SF area and ~628 CY of fill) to re-establish the natural shoreline; excavate 86 CY to relocate underwater rail launcher; remove a portion of a sunken barge; excavate 4,324 SF of northern side of peninsula, excavate 1,463 SF of rubble near rail launcher; replace an existing single-lane boat ramp with a 1,758 SF two-lane boat ramp; install a pump-out facility for acceptance of boat wastewater. The marina's wastewater will be connected to the Municipal sewerage system. The proposal does not include fuel dispensing. The proposal includes up to 12 moorings, under the jurisdiction of US ACOE (not DEC). The project is also under review by the Adirondack Park Agency, APA #2010-0189. The project is located just north of the DEC public boat launch in the Village of Port Henry.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
