Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and made a tentative decision to approve an application for an Air State Facility Permit modification for Agro-Farma's yogurt production facility located at 669 County Route 25, New Berlin, NY 13411. The modification to the facility's Air State Facility permit is to replace two existing No. 6 fuel oil fired boilers with two new No. 2 fuel oil fired boilers of larger size. The new No.2 fuel oil fired boilers are subject to 40 CFR 60, subpart Dc, Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units.

The draft permit includes a facility‑wide federally enforceable emissions caps to keep total facility emissions of sulfur dioxide below the major source threshold for this pollutant of 100 tons per year. The facility is required to track emissions on a monthly basis and include a summary of annual emissions to the Department in the facility's annual capping certification report.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 26, 2010.

Project Description:

The Town of Hastings proposes to extend Water District D to serve parcels along portions of US Route 11 and Baratier Road. Approximately 5,000 gallons per day from OCWA will be served through 8,600 linear feet of new water mains and apputenances. Where the water main on Baratier Road crosses freshwater wetland MX-1 an open cut trench method will be used. Project plans are available for review at the Syracuse Office.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
