Project Description:

The Department has made a tentative determination to approve a modification application for SPDES permit to discharge 5,000 gallons per day (gpd) of sanitary wastewater to a tributary of Mud Creek from the Hudson Park Restaurant. The treatment system will replace an existing system and will include the construction of a 5,000 gallon septic tank and a 5,000 gallon flow equalization tank, a Advantex Treatment System and force main and gravity piping.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance and as such, does not signify department approval for or endorsement of the activity for which a permit is sought. The proposed facility is located on the west side of NYS Routes 9H & 23 immediately south of the Greenport town line in the Town of Livingston. A draft permit is available for inspection and comment at the Region 4 office.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Greenport Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 19, 2010.

Project Description:

The applicant proposes the installation of a 48" diameter culvert within the stream/wetland corridor (State FWW C-2) to provide an established crossing for farm animals and to isolate animals from the stream by providing a riparian herbaceous buffer of 35 feet on both sides of the stream. The footprint of work to install the culvert is approximately 20 feet wide by 200 feet in length.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
