Project Description:

The applicant proposes to restore stream flow in a drainage swale at Robert Frost Middle School by removing approximately 587 cu. yds. of sediment. The sediment is proposed to be trucked to an approved upland location for disposal. The purpose of the project is to alleviate the flooding which occurs in this area during heavy rains and to restore the stream to its normal flow condition. The proposed project is located in a drainage swale associated with the Carlls River on a Suffolk County ROW which runs along the Robert Frost Middle School property at 450 Half Hollow Road in Deer Park, Town of Babylon in Suffolk County, SCTM# 100-041-01-21.2.

Project Description:

The Department has prepared draft permits and made a tentative determination to approve the application to renew the facility's Title IV and Title V permits, and to modify the Title V permit. The permits will be renewed for 5 years, and the Title V permit will be modified to include conditions recently promulgated under regulations 6 NYCRR Parts 243, 244, and 245. These regulations require facilities to obtain/possess at least as many 'allocations' of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. An 'allocation' is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency's (EPA's) recent "Clean Air Interstate Rule" (CAIR). The regulations are included in New York's ' State Implementation Plan' (SIP) which has been approved by EPA as required by the Clean Air Act of 1990.

The facility consists of four (4) 385 MWe nominal turbine/generator boiler sets operating on natural gas, #1, #2, #6 fuel oils, and other authorized fuels. In addition, a 15 MWe nominal black start combustion turbine is maintained on site to meet load demand and emergency power requirements, and there are 5 main tanks for storing #6 fuel oil along with numerous smaller tanks that store distillate, lubrication and/or dielectric oils.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
