Project Description:

The applicant proposes a new 9.8-acre Life-of-Mine sand and gravel mine, to produce sand for winter road use. The proposal includes material processing by use of screening equipment. The maximum depth of the excavation is 19.5'. The extimated Life of the mine, including reclamation is 25 years. The hours of operation will be Monday - Friday 7:00 AM - 2:00 PM, no weekends or holidays. The proposed maximum truck trips per hour is 5, with an average of 3. Mining will progress from south to north. The mining will be above groundwater, and all surface water will be retained on-site. The applicant proposes to disturb up to 5 acres at any one time, with concurrent reclamation. The reclamation plans include regraded slopes to 1V:2H, to be planted with conservation seed mix, eventually converted back to forest land. The mine is located on a 204.5-acre parcel, on the north side of State Route 9 in the Town of North Hudson. The Adirondack Park Agency also has jurisdiction over this mining proposal, APA #2010-83.

Project Description:

The Department (DEC) has prepared a draft permit and made a tentative determination to issue a renewal of the existing Air Title V Facility permit for the Pearl Leather Finishers facility, where leather finishing (surface coating) processes are performed. The renewal does not increase any allowable emissions or impose any new regulations. The DEC has determined that the facility is not subject to 40 CFR 64 "Compliance Assurance Monitoring" (CAM). Therefore, the existing CAM rule requirement has been removed from the draft renewal permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant has proposed to construct an instream sediment basin of approximately 150' long x 30'-45' wide, to a depth of 6', at the mouth of English Brook, designed to reduce the water velocity to allow sediment to fall out of suspension prior to entering Lake George. Maintenance of the basin will be conducted on a regular basis by Warren County Soil and Water Conservation District.
