Project Description:

The applicant proposes to modify an existing discharge of stormwater runoff from a transloading (material handling) facility and secondary containment system from the facility located at the Albany Terminal, 43-49 Erie Blvd., Albany, New York. The applicant proposes to increase the number of types of fuels and liquids it loads and unloads from rail cars and trucks, including naphthalene, impacted ground water, jet fuel, diesel fuel and other materials. Some materials will be handled on a regular basis, while others may be handled occasionally or only once. Best Management Practices and monitoring parameters will be used to ensure that discharges do not exceed allowable limits or leave the containment area.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge elimination system Permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the Region 4 Office. Refer to this application by application number listed above and SPDES Number NY 0261114.

Project Description:

Modification of the timing of the construction of structural berms within Norlite's Southern Overburden Storage Area. Norlite currently has a Mined Land Permit (MLF #4-0002) which includes the Southern Overburden Storage Area which receives non-rock soil material from the permitted hard rock quarry area. The current permit allows Norlite to operate within the Southern Overburden Storage Area during cold weather months (November through April) of each year. This Modification would allow Norlite to construct Structural Berms 2 through 6 during the summer months (May through October) which will enhance the structural integrity of the berms by allowing more effective compaction of soils. No other modifications to the existing Mined Land Permit are proposed with this modification.

Project Description:

The applicant proposes the construction of a mixed-use commercial development to consist of a four-story hotel, single-story 5,400 square foot diner and single-story 4,600 square foot office/medical/retail building with associated access roads, parking and stormwater management facilities to be located on the 10.57 +/- acre site. The project will occupy 4.7 +/- acres of the site and will result in 0.09 acres of permanent impact to federal wetlands. To mitigate for impacts to aquatic resources, the remaining 2.36 +/- acres of undisturbed wetland areas on the site will be protected from future development in perpetuity via a declaration of restrictive covenants.
