Project Description:

Applicant proposes to reconstruct the existing seawall which protects West Shore Road along the west shoreline of Oyster Bay Harbor in the Village of Mill Neck. Some sections of the existing, early 20th century seawall have deteriorated and have been repaired or stabilized over the last 80 years by different methods, including the installation of gabions, resulting in a patchwork structure made up of sections with varying levels of structural integrity. The current proposal addresses the full length of the seawall in phases and involves the installation of approximately 7,100 linear feet of new steel sheetpiling wall and 1,850 linear feet of prefabricated concrete block gravity wall.The project also includes the installation of a new positive drainage system for the roadway consisting of catch basins, piping and nine hydrostatic stormwater treatment units with outfalls to the harbor. This work necessitates the complete reconstruction of the road for approximately two miles, from the railroad bridge north to the Bayville Bridge. The alignment of the replacement wall will be about two feet seaward of the existing structure for most of its length, with some sections installed landward of the existing structure. This encroachment into the regulated area will be offset in at least a 2:1 ratio by the removal of existing gabions and other structures seaward of the replacement wall alignment. The project will result in a net gain of approximately 20,000 square feet of beach area seaward of the replacement wall.

Project Description:

The Department has prepared a draft permit renewal and has made a tentative determination to issue a permit pursuant to Article 19 (Air Pollution Control) of the New York State Department of Environmental Conservation Law (ECL) and Title V of Federal Clean Air Amendments, and made a tentative determination to approve this permit for the applicant's existing printing facility. The sources subject to the Title V requirements consist of a gas-fired SAMSCO water evaporator of 175 gallon capacity with a 55 gallon storage tank and 6 offset lithographic printing presses. The draft permit and application are available for public review at the Region One office.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
