Project Description:

The action is a 25.9 acre addition to the previously Department approved Mined Land Reclamation (MLR) Permit for the Rauh Aggregate Mine (presently 30.4 acres permitted), for the mining of sand and gravel. The mine and expansion land is on land owned by Kingsview Enterprises, Inc., with the mine operated by H.H. Rauh Paving, Inc., a division of Kingsview Enterprises, Inc. The additional acreage is adjacent to the area currently permitted for mining, and is made up of three (3) areas referred to as the North (9.6 acres), South (2.5 acres), and East (13.8 acres) Areas. With the additional acreage, a total of 56.3 acres out of 283.6 acres owned by the applicant at this site will be permitted for mining purposes. Culverts will be installed in Pickett Brook and tributary 8 of Pickett Brook (which will be removed upon reclamation of the site) to create a haul road between the North Area and the existing processing plant. There will be no mining activities within NYS regulated Freshwater Wetland CS-4, nor its 100 foot wide regulated adjacent area. Excavation below the water table is proposed in the North Area, which will result in a deep water lake. There will be no excavating of material in the South Area, which will only be used for storage of overburden. Existing material processing will continue at the current location without any changes. The South and East Areas will be reclaimed to dry meadow and farmland. The reclamation in the North area will be a 6.8 acre lake and meadow.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to renew the Title V Permit for the SKF Aeroengine North America facility (formerly MRC Bearings) in Falconer, NY. The company manufactures specialized ball and roller bearings, and is subject to a 6NYCRR Part 201-6, Title V Facility Permit because of its potential to emit volatile organic compounds (VOCs) in excess of 50 tons per year. As required by 6NYCRR Part 212.10(b), the company submitted a VOC Reasonably Available Control Technology (RACT) Compliance Plan which has demonstrated that an overall removal efficiency of 81% could not be met due to reasons of technological and economic feasibility. The Department has determined a variance from the VOC RACT requirements is appropriate. The terms and conditions of the variance limit the VOC emission rate of the two affected sources to 21 tons per year.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The applicant proposes construction of a nature trail (1,610 linear feet) through 110 acres of land recently donated to the Town. The project will impact no more than 0.08 acre of State regulated Freshwater Wetland LP-34 and its adjacent area, due to installation of a wood mulch trail and construction of an above-ground boardwalk section over the portion of the wetland that is wet year-round. Mitigation shall consist of educational signs posted along the boardwalk.
