Project Description:

The Department has tentatively determined to issue a State Pollutant Discharge Elimination System (SPDES) permit for the continued discharge of 16,500 GPD treated sanitary wastewater to a subsurface system at the Fabius-Pompey Central School along Route 80 in the town of Fabius. A draft permit is on file and available for review by appointment.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Applicant proposes to renew operations at a previously-permitted 64 acre mine site on a 90 acre parcel. Acreage proposed to be affected during the coming 5 year term is 23.67 acres. Minerals extracted will include clay and weathered shale. Processing may occur on site, as may a topsoil manufacturing operation where mulch and other soil amendment will be mixed with overburden materials to produce manufactured topsoil. The mine site is located along Brickyard Road opposite the State Thruway service area in the Town of Van Buren.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
