Project Description:
The applicant proposes the construction of a stormwater detention facility in an attempt to reduce localized flooding. The basin will require the distrubance of approximately 620 feet of a Class C non-navigable tributary of Cayuga Lake. The U.S. Army Corps of Engineers has issued a provisional permit and a stormwater pollution prevention plan has been prepared.

State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:

Project Description:
The Department has received an application from Austin Construction LLC for a 9.9 acre expansion of an existing sand and gravel mine on McCarthy Road in the Town of Erwin. The current permit authorizes operation in a 22 acre life of mine area. The approved life of mine area was subsequently measured to a higher degree of accuracy and was found to be 17.4 acres. The 9.9 acre expansion proposed will increase the life of mine area to 27.3 acres.
Excavation is proposed to remove an additional 800,000 cubic yards of sand and gravel from the 9.9 acre expansion area over the next 12 years. Material will continue to be processed by a portable crushing and screening plant on site. Excavated sand and gravel will be stockpiled for loading onto trucks. The applicant has estimated maximum traffic from mining operations to remain at 10 truck trips per hour, and to average 20 truck trips per day.
Mining is not proposed below the local water table. Proposed final contours show grades that will retain storm water runoff within the mined area. No off site discharge of storm water runoff will be permitted. There are no NY State regulated streams or freshwater wetlands within the Life of Mine area.
Hours of operation proposed are unchanged from current operations. Final reclamation to vegetated open land is proposed, and will include the replacement of stockpiled topsoil and seeding with an approved mixture.
The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Erwin.
