New York State Department of Environmental Conservation Implements Quarantine to Prevent Spread of Emerald Ash Borer

The New York State Department of Environmental Conservation (NYS DEC) is expanding the boundaries of the existing quarantine district comprising Chautauqua and Cattaraugus Counties to include Allegany, Chemung, Erie, Genesee, Livingston, Monroe, Niagara, Ontario, Orleans, Schuyler, Steuben, Wayne, Wyoming, and Yates Counties in order to limit the potential introduction of the invasive Emerald Ash Borer (EAB) to other areas of the state.

NYS DEC's quarantine order will prohibit the intrastate movement of EAB, and the movement of ash nursery stock, ash trees, and ash wood products, and firewood, wood chips and bark mulch from any tree species beyond the quarantine district without certification or compliance agreements from the New York State Department of Agriculture and Markets, or the Animal and Plant Health Inspection Service of the United States Department of Agriculture (APHIS), in addition to other provisions as defined in the order.

Negative Declaration

Yates County - The Town of Jerusalem Planning Board, as lead agency, has determined that the proposed Harbor View Town Homes Project will not have a significant adverse environmental impact. The action involves the removal of two steel buildings and two houses; the construction of two 5 unit townhouse buildings, a shed, and a clubhouse; the re-construction of parking areas; and the construction of a new sewage disposal system. The project is located at Mill Street and NYS route 54A (aka West Lake Road, Branchport) in the Town of Jerusalem, New York.

Positive Declaration and Public Scoping

Genesee County - The Town of Batavia Planning Board, as lead agency, has determined that the proposed Gardner Estate Subdivision may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until the close of business October 19, 2010. A public scoping session will be held on October 5, 2010 at 7:30 p.m. at the Batavia Town Hall. The action involves the construction of a new subdivision to be known as the Gardner Estates Subdivision which will consist of 13 two family housing units with a community center and include related facilities such as roads, water, sewer and drainage systems along with appropriate storm water treatment measures. The project is located 5017 Clinton Street Road in the Town of Batavia, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Monroe County - The Penfield Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Bay Towne Plaza Redevelopment. A public hearing on the Draft EIS will be held on October 14, 2010 at 7:00 p.m. at the Penfield Town Hall, 3100 Atlantic Avenue, Penfield, NY 14526. Written comments on the Draft EIS will be accepted by the contact person listed below until October 25, 2010. The Draft EIS is available on the Town of Penfield Planning Department's web page on the Town website located at: www.penfield.org.

The action involves an application by DiMarco Brandt Point LLC to the Town Board to Amend the Town Zoning Map to rezone two parcels currently zoned R-1-12 and Multiple Residential, to General Business to expand the existing Bay Towne commercial development. The parcels are located north and east of the existing DiMarco Baytowne Associates, LLC parcel, commonly known as Bay Towne Plaza at 1994B and 1994C Empire Boulevard in the Town of Penfield, New York.

The action involves a proposed a mixed-use project incorporating a variety of housing options, retail, office, hotels and recreational opportunities. The development will create pockets of living and office space over 1st floor retail, with a parking structure and surface parking lots throughout the site. Public amenities include open space and access to the Erie Canal and multi-use trails. The project is located at the southeast corner of the intersection of East Henrietta Road and Westfall Road, approximately 44 acres are located within the City of Rochester and 19 acres are located in the Town of Brighton, New York.
