Project Description:

The applicant proposes a 35 acre expansion of a 122 acre sand and gravel mine. The new mine area is on property owned by Donald Cook. The new area is to the south of Chenango Concrete Corp.'s currently permitted lands. The area is approximately 1.5 miles north of NYS Route 12 on the west side of County Route 23. This area is east of DEC Regulated Freshwater Wetland E-10. The proposed mine site is located in an area considered to be potentially archaeologically significant and the following description more fully describes the State Historic Preservation Act Determination below. A phase I assessment was performed for the entire site. The Office of Parks, Recreation, and Historic Preservation (OPR&HP), recommended that a phase II evaluation be prepared for the proposed site. A phase II study was performed on a 3.5 acre section of the 35 acre site. OPR&HP has no further concerns with the 3.5 acre area. A permit, if issued, will require that a Phase II study be performed for the remainder of the proposed site by the applicant, evaluated by OPR&HP and a no impact determination made prior to its release for mining.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 08, 2010.

Project Description:

To operate an unconsolidated surface mine to extract topsoil and subsoil. Initial mining will affect 10.6 acres of a total 66.9 acres. The total life of mine could be 51.9 acres pending future approvals and cultural resource surveys. Reclamation objective is private recreational use. A portable screening plant will be on-site.
