Project Description:

The Department has received an application for the creation of Town of Geneva Water District #12 and to take for use therein a supply of water in amounts up to 12,000 gallons per day from the Town of Geneva's Kashong Point well field supply. The project includes installation of 18,000 linear feet of 12-inch, 8-inch, 6-inch and 2-inch watermains and appurtenances to serve portions of Pre-Emption Road, Hastings Road, Haley Road and Braewood Lane. A portion of the watermain will be installed within the regulated 100 foot adjacent area of NYS regulated freshwater wetland ST-19. Proper sediment and erosion controls will be utilized to maintain the water quality standards of the wetland.

The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment on the project prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Geneva Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 16, 2010.

Project Description:

The applicant proposes the following work within waters of the U.S. associated with the reconstruction of the I-86 bridges over Meads Creek and portions of the Exit 42 interchange: approximately 0.26 acres of fill in roadside wetlands; approximately 300 linear feet of stream bank enhancements in Meads Creek (DEC Index No. PA-3-58-3; Class C(T)); replacement of two, 42-inch culverts in a tributary of Meads Creek; and the replacement of the I-86 bridges over Meads Creek. The proposed stream enhancements consist of three rock vanes to be installed in Meads Creek for bank stabilization. In addition, a flood control berm approximately 600 feet long would be constructed along the north side of I-86 to reduce highway flooding. A Stormwater Pollution Prevention Plan has also been prepared in accordance with the Department's SPDES General Permit for Stormwater Discharges from Construction Activities (GP-0-10-001).

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
