Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY-0257001, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York States's Environmental Benefit Permit Strategy (EBPS).
The Taberg Sewer District Wastewater Treatment Facility is an existing facility with a design flow of 32,000 gallons per day. Treatment consists of two 16,000 gallon septic tanks followed by sand filtration. The facility uses chlorine for disinfection from May 1 through September 30. The facility has treated surface discharge to the East Branch Fish Creek, a class C(T) water.
Monitoring and effluent limits for Fecal Coliform have been added. Sampling frequency for Temperature, pH, Total Residual Chlorine, and Settleable Solids were changed to 5 per week. Sample collection method for 5-Day Biochemical Oxygen Demand and Suspended Solids were changed to grab. Discharge Notification requirements have been updated. Monitoring page with a flow diagram has been revised. Permit pages have been updated to reflect current DEC format and nomenclature. The permittee names and addresses have been updated.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes to expand a permitted 4 acre sand and gravel mine to include an additional 15.8 acres. The site is located on an 867.9 acre parcel owned by Benson Mines, Inc., 100 Bay Street, Glens Falls, New York 12801. The site is further located east of County Route 60, approximately 2,500' north of the intersection of State Highway 3 and County Road 60. Mining will be traditional surface mining using mechanized equipment. On site processing such as crushing with a portable crusher and screening as needed may take place. Approximately 200,000 tons of material is estimated to be removed over an estimated 30 year life of mine operation.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
