Project Description:

The applicant proposes to develop a 10 lot subdivision that will require the filling of 0.21 acres of acres of federally protected wetland and the relocation of 1,034 linear feet of ephemeral stream course. Nine lots will be developed and the final lot is occupied by a 500,000 gallon underground water tank. Potable water for the subdivision will be supplied by the Ski Windham Operating Company under their current water supply permit. Wastewater will be directed to the Town of Windham Wastewater Treatment Plant.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0020290), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This is a renotice of the Notice of Intent to Modify for the above facility's SPDES Permit published in the Environmental Notice Bulletin on 8/11/2010 and 8/18/2010. The 8/11 Notice of Intent to Modify incorrectly stated facility treatment consists of chlorination and sludge disposed at incineration. This wording has been removed. The 8/18 Notice of Intent to Modify did not include a Mercury Minimization Plan and limit additions to the proposed draft permit. The correct proposed changes to the permit follows:

The City of Amsterdam Wastewater Treatment Plant has a design flow average of 10.0 mgd. Treatment for sanitary discharge consists of screening, grit removal, belt filter press, primary settling, activated sludge, and secondary settling. The following changes to the permit are proposed: - The action level for Bis(2-Ethylhexyl) phthalate has been increased. - The designation for Copper has been changed from Total Recoverable Copper to Total Copper, which are chemically equivalent. Also, the Copper limit has been converted to an action level and increased. - A daily maximum limit and daily average monitoring for Mercury, Total has been added - New Whole Effluent Toxicity Testing requirements for Acute, and if necessary Chronic, and associated action levels have been added. The schedule of compliance for completing an I/I study and report has been deleted, as this requirement is being addressed in an order on consent. - Long Term Control Plan requirements have been updated.
