Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Clean Air Act Amendments for Broome Energy Resources LLC's Gas Recovery facility located at Knapp Road, Nanticoke, NY.

Broome Energy's Broome County Facility includes an existing landfill gas (LFG) collection system and a LFG-to-energy facility. The facility is currently operating under a NYS Environmental Conservation Law Article 19 Air State Facility Permit. The LFG collection system is installed in Sections I, II and III of the landfill. The LFG- to-energy facility located adjacent to Section I includes up to six (6) Caterpillar 3516 engines/generators that generate up to 4,920 kilowatts of energy (total). One of the six Caterpillar 3516 engine/generators will be used as a back-up/standby unit. The facility also currently operates two (2) caterpillar 399 engines and one caterpillar 398 engine (designated engines 1, 2, and 3). Engines 1, 2 and 3 are scheduled to be decommissioned upon commercial operation of engines 5 and 6. The facility also includes one (1) candle flare to burn excess LFG. The system is designed such that the candle flare burns excess LFG in the event of engine failure or maintenance and will be utilized when LFG in excess of the available capacity of the engines must be combusted.

The draft permit includes facility‑wide federally enforceable emission limits (caps) to keep total facility emissions of oxides of nitrogen below the major source threshold for oxides of nitrogen of 100 tons per year, and emissions of carbon monoxide below the applicability threshold of 40 CFR 52.21 (PSD) of 250 tons per year. Emissions of nitrogen oxide and carbon monoxide, and facility operating parameters (such as landfill gas flow rates) are required to be determined on a monthly basis and reported to the Department in the facility's annual compliance certification report.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The DEC proposes to modify this existing permit authorizing a monthly average discharge of 16,500GPD treated sanitary wastwater to absorption beds. Discharge is from the Whispering Oaks Subdivision in the Town of Lysander. Modifications to the permit include: 1. Require flow monitoring based on influent pump run time. 2. Water quality based limit for pH of 6.5 to 8.5. Require monthly monitoring, and 3. Compliance schedule item requiring submittal of monthly maintenance report. A copy of the draft permit modification is available at the DEC Syracuse office for review.
