Project Description:

The applicant proposes to construct a 20' wide x 170' long corduroy road crossing of regulated freshwaer wetland HM-70, a 167 acre Class II mixed wooded, shrub and wet meadow wetland. The road would provide access to isolated woodland for forest management. The crossing site is predominately a humocky hemlock/spruce wetland with fern/sedge understory. Four culverts are proposed for identified areas of standing surface water. A driving surface of gravel would be placed on the logs. The site is located approximately one mile southeast of the hamlet of Fish Creek, 0.05 miles east of Fish Creek Road, 4.5 miles northwest of West Leyden.

Project Description:

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is for a Department Initiated Modification of a permit pursuant to 6 NYCRR Part 750-2.18 and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

Griffiss Utility Services Corporation discharges a daily average of 1,160 gallons per day of untreated stormwater from a petroleum bulk storage secondary containment area through Outfall 002 to an unnamed tributary of Sixmile Creek, a class C water from Griffiss Central Heating Plant located in Rome, New York.

The following changes to the permit are proposed: Effluent monitoring and action level for Naphthalene has been added to Outfall 002. Effluent monitoring for daily maximum flow has been added to Outfall 002. Special Conditions for industrial Best Management Practices requirements have been added. Monitoring page with a flow diagram has been revised. Discharge Notification requirements have been updated. Permit pages have been updated to reflect current DEC format and nomenclature. The address for the permittee has also been updated.

This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Project Description:

The Department has drafted a modification to the Title V permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments for the existing facility located at Corning, Inc. - Canton Plant, Canton, New York. The facility produces several types of high purity specialty glass. The primary SIC code for the facility is: 3229 - pressed and blown glass. The facility consists of Emission Units: U-00001, U-00002, U-00004, U-00005 and U-00006. The facility is a major emitter for Nitrogen Oxides.
The glass forming furnaces included in emission unit U-00001 are subject to Part 231-2 and 40 CFR 52.21 and limited to 427.43 tons per year of Nitrogen Oxides. Emission units U-00005 and U-00006 are limited to 79,210 lbs/yr of nitrogen oxides and 79,500 lbs/yr of sulfur dioxide. The modification is to include conditions for CAM, 40 CFR 64 since the facility is major for PM prior to controls.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
