Project Description:

The Department has prepared draft permits and made a tentative determination to approve the application to renew the facility's Title IV and Title V permits, and to modify the Title V permit. The permits will be renewed for 5 more years, and the Title V permit will be modified to include conditions recently promulgated under regulations 6 NYCRR Parts 243, 244, and 245. These regulations require facilities to obtain/possess at least as many 'allocations' of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time.

An 'allocation' is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency's (EPA's) recent "Clean Air Interstate Rule" (CAIR). The regulations are included in New York's ' State Implementation Plan' (SIP) which has been approved by EPA as required by the Clean Air Act of 1990.

This facility consists of two (2) 185 MW steam electric boilers operating on either natural gas or #6 residual fuel oil, and a 12 MW "black start" combustion turbine which provides emergency restart power in the event of a failure in the electric grid and also provides additional capacity to the grid during peak load days

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The applicant, known as Atlantis Marine World & The Riverhead Foundation for Marine Research and Preservation, located at 431 East Main Street in Riverhead, proposes to increase the flow rate of its existing discharge to 10,150 gallons per day of untreated wastewater to the Peconic River and groundwater in order to accommodate facility expansion. The Department of Environmental Conservation has made a tentative determination to renew and modify the facility's existing State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law by changing and adding effluent limitations. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify DEC approval for, or endorsement of, the activity for which a permit is sought or for the overall proposed project. A draft permit and the permit application materials are available for review from the contact person listed below. Please refer to the Application ID number listed above and SPDES number NY0226459. The discharge is located within an area designated as a sole source aquifer. The following public water purveyors have been identified as having service areas located within a three mile radius of the facility: Riverhead Water District and Suffolk County Water Authority.
