The Department's Region 9 Office proposes the following temporary permit changes for work in streams conducted under the General Permits described in this notice for rock riprap; bioengineered streambank stabilization; and tree revetment installations: 250 feet, revised to 500 feet and the work date restriction of September 1st, revised to September 15, 2010 or beyond if warranted. The described permit changes are due to the large number of stream restoration/erosion protection projects proposed because of the devastating August 9-10, 2009 storm, which severely damaged streams regulated pursuant to Article 15, Title 5 of the Environmental Conservation Law (Protection of Waters) in Cattaraugus, Chautauqua and Erie Counties. By providing this regulatory relief, most project work can be performed under the Cattaraugus County Soil and Water Conservation District's General Permit, which will expedite permitting work proposed under the Natural Resources Conservation Service's Emergency Watershed Protection, Federal Emergency Management Agency's Disaster and Federal Highway Administration's funding programs. These temporary changes only apply to proposed work carried out under the noted funding programs and will end on December 31, 2010. After that date, the former General Permit conditions will again apply to new work.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 29, 2010.

The applicant proposes approximately 590 linear feet of bank stabilization utilizing slope and toe rock riprap protection, installation of five rock stream barbs and biotechnical plantings to protect the streambank, gas line and road. Work also includes in-stream debris removal. The project area is approximately 1,200 feet downstream of the Hillcroft Road bridge.
