Project Description:

Notice of Completeness - AES Westover, Johnson City, NY - Title V Renewal

The Department has prepared a draft permit and has made a tentative determination to issue to AES Westover a renewal of its Title V air permit.

The prior Title V operating permit issued to AES Westover authorized the operation of three pulverized coal fired boilers. Substantial changes have occurred since the last permit was issued. AES has retired two boilers, designated 11 and 12, and now operates only Boiler 13, which provides steam to turbine Unit 8. Boiler 13 is now equipped with a selective catalytic reduction unit for control of oxides of nitrogen and a dry scrubber and fabric filter for acid gas and particulate matter removal. In addition to these physical changes, the DEC has adopted rules to implement the EPS's Clean Air Interstate Rule, a new mercury cap rule and a CO2 budget rule. This permit includes conditions to implement these rules.

The facility also has a 32 mmBtu/hr gas-fired package boiler. Please note that the existing Title IV (Phase II Acid Rain) permit for this facility is also being noticed at this time.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The Department (DEC) has prepared a Draft Permit and has made a tentative determination to approve this application for renewal of an existing Title IV (Phase II Acid Rain) Permit as required by CFR Part 72 for AES Westover, located at 720 Riverside Drive, Johnson City, NY. Renewal of the Title IV Permit will allow the DEC to continue to enforce the requirements of the Acid Rain Program. No emissions increase will result from renewal of the permit. Prior permits issued to this facility remain in force and include requirements for compliance with 6 NYCRR Subparts 225-1 (Fuel Consumption and Use - Sulfur Limitations), 227-1 (Stationary Combustion Installations) and 227-2 (Reasonably Available Control Technology [RACT] for oxides of nitrogen [NOx]). The applicant will be required to have sufficient sulfur dioxide (SO2) allowances in its possession to cover SO2 emissions from this facility. The applicant shall submit annual compliance certification reports to DEC and the US Environmental Protection Agency (EPA). The applicant shall monitor, maintain and certify monitoring systems for opacity, SO2 emissions, NOx emissions, carbon dioxide emissions and volumetric flow rates in accordance with the requirements of 40 CFR Part 75. In accordance with 6 NYCRR Parts 621 and 201, the Administrator of the EPA has authority to bar issuance of this permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Please note that the Title V permit (7-0346-00045/00006) for this facility is also being noticed at this time.
