The permittee is requesting a modification to the SPDES permit for the NRG Dunkirk Generating Station. NRG Dunkirk Steam Station (Dunkirk) is a coal-fired, 628 MW facility located on Lake Erie that consists of four units that went into operation in 1950, 1950, 1959, and 1960 respectively.
This proposed draft permit contains a permittee requested modification that follows the November 2009 Department Initiated Modification. This modification addresses the applicants petition and includes the following changes: 1) a new action level for selenium of 0.004 mg/l at Outfall 001; 2) changes to permit levels and monitoring frequency for seven different metals at Outfall 005; 3) a revised due date of 15 February for the annual compiliation and evaluation of the groundwater monitoring data for the previous calendar year; 4) changes to the schedule of compliance to include a request for the "water flow diagram" and a short term high-intensity mercury sampling program; and 5) refinements to the groundwater monitoring program requirements to include specifying the EPA Method for mercury analysis.

State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Jul 23, 2010.
