Project Description:

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is for a modification of a permit for an existing discharge of a varying amount of treated process wastewater into the Beaver River, a Class C waterbody from a biological treatment plant at the applicants facility located at Beaver Falls, Lewis County. The applicant plans to add additional cooling water to the treated wastewater in order to decrease the temperature prior to discharge to Beaver River. Except for temperature, compliance monitoring will take place prior to the addition of the cooling water.

This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for an endorsement of the activity for which a permit is sought or for the overall proposed project. Project Description:

The applicant proposes to develop and operate a 30.5 acre surface sand and gravel mine within a 229.1 acre parcel 6,000 feet north of the hamlet of Hermon. The project calls for the mining of 29.95 acres of land with 0.42 acres haul road. The project site is on property owned by Cedric Kirkpatrick and identified as Tax Parcel No. 117.003-2-9 and is located approximately 1,000 feet west of County Route 21, with the entrance road located approximately 6,000 feet north of the hamlet of Hermon. The mine is intended to operate as a traditional surface extraction of the Hailsboro silt loam, Kalurah fine sandy loam, Nicholville very fine sandy loam, Pyrites fine sandy loam and Pyrites and Kalurah Soils which occupy the site. Mining is not proposed to take place below the local water table which is believed to be at least 10 feet below the level of the proposed excavation. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material from the bank face. Mining is proposed to remove over one million cubic yards sand over the estimated 50 year operational life of the mine. Material will be stockpiled as unprocessed run-of-bank, or processed with portable screens. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to vegetated open space to promote wildlife habitat. Mine areas will be graded and stockpiled topsoil will be spread, and seeded with an approved USDA SCS seed mixture. The reviewed life-of-mine area is 30.5 (LOM) acres.

Project Description:

Applicant proposes to expose 2 existing 16" and 20" diameter steel natural gas pipelines in order to re-coat with a new protective epoxy. The excavation of the proposed trench to expose the 2 pipelines will involve excavating approximately 1167 cu. yds (300' L X 15' W X 7' D) of soil. Total disturbance of DEC FWW UE-14 will be approximately 15,000 sq ft. Proposed work involves trenching, backfilling, and swamp mat place. All disturbed wetland and upland areas will be restored to pre-existing contours and stabilized using appropriate seed mixes.
