Project Description:

The applicant requests a modification to the Air State Facility permit to 1) add Emission Unit 0-00RAP for crushing Recycled Asphalt Pavement (RAP), with a production limit or "cap" to 150,000 tons/year, that will be a feedstock to the facility's currently permitted Hot Mix Asphalt batch plants, 2) raise the 750,000 tons/year production limit "cap" on aggregate processing to 1,500,000 tons/hour, 3) raise the 150,000 cubic yards/year production limit "cap" on concrete batching to 200,000 cubic yards/year. The requested revisions to stone and conrete batch plant limits are based on updated emission calculations, not because of substantive change in facility oepration. The production limit "cap" of 465,000 tons/year for hot mix asphalt production remains unchanged.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 25, 2010.

Project Description:

The applicant proposes an expansion, by 10.2 acres to the north, of the currently permitted 36.1 acre sand and gravel mine. The site, located 1,000 feet north of LaPlante Road, is part of a 180 acre parcel owned by Glendon Rafferty. Of the currently permitted 36.1 acre site, 32.7 acres have been mined. Of those, 7.8 acres have been reclaimed, 6.9 acres will be reclaimed during 2010, and 18 acres will be reclaimed over the next several years. In sum, 13.6 acres (3.4 currently permitted and 10.2 proposed expansion) will be mined over the next several years. Proposed mining operations for the new, 10.2 acre expansion area are consistent with the operations currently authorized, including: onsite processing, hours of operation, production rates, and utilization of the existing haul road. Upon completion of mining, all affected areas will be reclaimed so that the entire site returns to its pre-mining condition as an undisturbed woodland.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 24, 2010.
