The project is located on Route 219 in the Town of Carrollton.

The Department has made a tentative determination to approve a modification to this Air State Facility Permit which includes an existing federally enforceable emission cap that limits Sulfur Dioxide (SO2) to no more than 90 tons per year to avoid major source permitting. Modifications include the addition of 2 emission points, clarification for visible emissions inspections, updates to stack parameters for some current emissions points, and a revision to the SO2 emission cap calculation to reflect the removal of 2 and the addition of 1 combustion source.

Project Description:
The Department has prepared a draft permit and has made a tentative determination to issue a permit modification which reflects the reincorporation of the Compliance Assurance Monitoring (CAM) Plan and the removal of the area source requirement for Ferroalloys Production facilities, the National Emission Standards for Hazardous Air Pollutants (NESHAPs), 40 CFR Part 63.11524 Subpart YYYYYY(6Y). Testing of similar furnaces revealed that emissions of hydrogen chloride (HCL) were in fact in excess of 10 tons per year, therefore the facility is a major source of HAPs and thus CAM must be included in the permit.
In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
