Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0005622), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS), and to renew the permit which was extended under the State Administrative Procedures Act (SAPA). This modification also initiates a transfer from Mack Brothers Limited to Milmar Food Group LLC.
The Mack Brothers facility has a design flow of 100,000 gpd. Treatment consists of preliminary treatment to remove grease and solids, aerated lagoon, settling tanks, holding pond and overland flow. The facility has a treated surface discharge to the Rio Grande, a class C water. The following changes to the permit are proposed: Permit pages and conditions have been updated to reflect current DEC guidance, format and nomenclature. A water quality based effluent limit for ammonia, as well as in interim limit has been added to the permit. A technology based oil and grease limit has been added. A diagram of monitoring locations has been added. Boiler blowdown and cooling water has been added to the wastewater type. A schedule to submit corrected water treatment chemical forms has been added.

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to issue a renewal to the applicant's Title V Air Facility Permit.

Par Pharmaceutical, Inc. is a manufacturer as well as a research and development facility of pharmaceutical products. PAR is renewing its existing Title V permit. The facility is located in Chestnut Ridge, Rockland County, New York. The Standard Industrial Code (SIC) is 2834, "Pharmaceutical Preparations." Emissions of Isopropyl Alcohol used from cleaning operations have the potential to exceed 25 tons per year and the facility has opted for a Title V. Applicable regulations include Parts 201, 211, and 212 of 6NYCRR. The facility will limit emissions of Hazardous Air Pollutants (HAP) to below 10 tons per year individual HAP and 25 tons per year total HAP. Facility will keep usage records to demonstrate compliance with the cap.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The project sponsor proposes to remove 320 linear feet of an existing stacked concrete block retaining wall along the banks of School House Brook [Index# D-70-20-25-7a, Class B(TS)], a tributary of Willowemoc Creek. The block wall will be replaced with 345 linear feet of reconstructed stream bank. The reconstruction will consist of placing hardened toe protection, woody vegetation and the installation of three rock vanes within the stream channel.

The project sponsor proposes to place 360 Linear Feet of rip rap around an existing jetty/wharf (150' length x 60' wide) located on the Hudson River at the bottom of Parker Avenue for the purpose of preventing erosion.
