Project Description:
The applicant proposes to manage/remove stands of invasives species which include Japanese knotweed, phragmites, garlic mustard, common buckthorn and honeysuckle from a 14 acre property donated to the town by the estate of Robert Jacobs. The invasives would be removed by digging, cutting and the use of herbicides. The property has conservation easements and will be managed for low impact recreation and nature study. Other proposed activities include debris removal, the moving of downed trees and creation of amphibian habitat by excavating shallow depressions. The property is between Clinton Street and Buffalo Creek to the west of the Canisius High School sports field in the vicinity of Old French Road and includes a portion of state wetland BU-17 which is an oxbow of Buffalo Creek.

Project Description:
The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0000418), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). As a result of comments received from the permittee, this is a re-notice of the Notice of Intent to Modify published in Environmental Notice Bulletin on 1/28/09 and the Warsaw Country Courier on 2/6/09.
In addition to the proposed changes stated in the published notice of intent to modify, the following modifications are proposed: Biological requirements for cooling water intake structure is included in the revised draft permit and fact sheet. The monitoring of temperature has been revised to daily. An ammonia sampling program and monitoring has been included in the revised draft permit. The type of discharge for outfall 002 has been revised to read, Site Stormwater, groundwater & Outfall 02A Process Wastewater. Sample type for pH has been changed to Grab. The Total Dissolved Solids (TDS) monitoring program at Outfall IS3 has been changed to monitor. The unit for flow has been revised to GPD. Ammonia is covered under the approved workplan for ammonia and TDS monitoring program, thus the requirement for an engineering report has been removed from the schedule of compliance.The discharge limits for TDS have been revised to monitor for Outfalls 001 & IS3. Final resolution on the TDS will be determined when the DEC received the final report according to the schedule of compliance. The compliance action to total uncholorinated phenol has been modified. The Facility has surface discharge into Wolf Creek, a class C water.
