Project Description:

The department has made a tentative determination in accordance with its Environmental Benefit Permit Strategy to modify and renew a SPDES permit for the discharge of 0.190 MGD of treated wastewater from the Orleans (T) Thousand Island Park STP to the St. Lawrence River in the Town of Orleans, Jefferson County.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to mine 4.5 acres of sand and gravel from a 4,164 acre parcel. The site is located approximately four miles west of Carey Road, ten miles southwest of the Village of Lowville, well within the property boundary. On site processing will take place and mining will occur below the seasonal water table. Site reclamation will restore the site to preexisting contours, using overburden from other site activities, leaving the site suitable for forest regeneration. A water based pond reclamation may be considered depending on groundwater conditions and available backfill.

Project Description:

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is a re-issuance of an expired permit along with a minor modification of that previously existing permit. The permit allows for a discharge of up to 17,900 gallons per day of treated sanitary & incidental garage floor drain wastewaters into Brown Creek, a class C waterbody. Wastes result from a secondary biological sand filter system at the applicants facility located in Verona, Oneida County. The only change to the permit involves the addition of "Dissolved Oxygen" to the list of monitoring parameters and is not considered to be a significant change.
This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
