A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has prepared a draft permit (SPDES # NY-0275557) and made a tentative determination to approve an application for the discharge of 200 gallons per day of wastewater, from periodic vehicle washing, to Buffalo Creek. The draft permit will also authorize the discharge of up to 150 gallons per day of treated sanitary wastewater to groundwater via 2 septic tank/leach field systems.

Project Description:

The Department has prepared a draft SPDES permit (NY0255301) and made a tentative determination to approve the discharge from the above proposed subdivision. Phase 1 of the project includes 23 lot single family homes and its discharge of up to 6,900 gallons per day of treated sanitary wastewater from an on-site wastewater treatment system to groundwater. Phase 2 includes 24 lot single family homes and its discharge of 7,200 gallons per day of treated wastewater. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit and application materials are available for inspection at the Region 9 Office.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
