Project Description:

The applicant proposes to expand a 14 acre topsoil, sand and gravel pit on the Hurley property on Maple Avenue in the Town of Southport. The expansion will add 87 acres to the Life of Mine (LOM) acreage. The mining operation proposes to remove approximately 6.9 million cubic yards of material over the operational life of the mine. The mine will operate as a traditional surface excavation of topsoil, sand, and gravel using mechanical equipment, standard for this type of mining operation. Materials will be mined from below the water table to a maximum depth of 50, feet using an excavator, front loader, or dragline as appropriate. If required, on-site processing may include dry screening with a portable screener at a rate not to exceed 150 tons per hour. Final reclamation will restore the site to open space and wildlife habitat to include emergent wetlands surrounding an open water pond. Upland reclamation will include the replacement of stockpiled topsoil, and reseeding with an approved USDA SCS seed mixture. The reviewed life-of-mine expansion area is 87 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes to remove debris and contaminated soil from within approximately 0.7 acres of the 100-foot adjacent area of State-designated Freshwater Wetland RE-1 (Class I). The project site is located on the north side of Empire Boulevard, approximately 100-feet east of the mouth of Irondequoit Creek. Approximately 1,300 cubic yards of contaminated soil will be removed from the site, along with accumulated construction and demolition debris. Approximately 2,000 cubic yards of clean fill will be brought to the site to re-establish existing grade and as cover material. The work is necessary to prepare the site for eventual public use as a Town park.

As part of their normal right of way maintenance operations, the applicant proposes to make spot applications of herbicide to control vegetation growth along selected unmowable sites located along state routes that are also within the adjacent area of various state regulated wetlands. The work will be performed in the following counties: Genesee, Livingston, Monroe, Ontario, Wayne and Yates and all applications will be made by NYS certified pesticide applications in accordance with all product label requirements.
