Project Description:

The applicant proposes to replace two historic and unstable agricultural low-water crossings at an existing farm with two new stream crossings constructed within Freshwater Wetland DP-22 (Class I) and within two separate unnamed tributaries of the East Branch Croton River (both Class C). The northern crossing (#1) includes construction of a 27 foot long open bottom aluminum box culvert with wingwalls, construction of approximately 300 linear feet of rip-rap for embankment protection, and incorporates an integral amphibian crossing to allow safe movement of amphibians through the area. The southern crossing (#2) includes construction of a 40 foot long pre-fabricated wood and steel bridge with precast concrete abutments. The total area of disturbance within the wetland is 0.13-acre; the total area of disturbance to the adjacent area is 0.14 acre. An area approximately 0.16-acre in size will be cleared of invasive plant species and replanted and restored with native vegetation at the project site as mitigation. The Ames, LLC farm is located on the west side of NYS Route 22, south of the intersection with Aikendale Road.

Project Description:

DEC has determined to approve a request from the permittee for modification of the SPDES permit for the Village of Brewster WWTP. In a letter dated October 28,2008, the permittee requested removal of the 70 degree (F) effluent temperature limit from the SPDES permit. Regional Water and Fisheries staff visited the facility on November 28, 2008 to review the request. Based on that visit, DEC has determined that the 70 degree limit was overly restrictive-and would be removed. The temperature limit, pre-NYCDEP upgrade limits and a schedule of compliance were removed from the permit. A detailed monitoring location diagram was added and the Water Index number was corrected. Issuance of this modified permit is contingent upon the completion of an administrative renewal form by the permittee, which was included in the mailing sent with the draft modified permit. The current permit will expire 31 June 2010. The renewal form must be submitted to the DEC contact at the address shown below, or the permit may be allowed to expire and hence any future discharge from the WWTP would become a violation of the Environmental Conservation Law. The renewal form is due 01 May 2010.
