Project Description:

The applicant proposes to continue to operate a 4.9 acre shale mine on a 126 acre parcel of land owned by Joy Seufert, which is located on the north side of 145 Alcove Road. The mine is operated as a surface mine with the use of a bulldozer and backhoe to rip exposed shale, which is then loaded onto dump trucks for transport.

Project Description:

The City of Watervliet must perform repair work on the Dry River Lower Dam in accordance with the Schedule of Compliance outlined in the Modifed Order on Consent (DEC Case No. CO4-20090325-31). The repair work will also allow the dam to meet the requirements of passing the full Probable Maximum Flood (PMF).
Proposed work includes lowering the top elevation of the existing spillway by 6 feet, re-establishing the low-level outlets in the dam, removing accumulated sediment behind the dam, stabilizing 145 feet of the Dry River with rip-rap, and constructing a 650 feet long permanent access road.

The proposed project will result in a temporary impact to approximately 0.15 acre of stream channel associated the excavation of accumulated sediment behind the dam. Additionally, 145 linear feet of stream will be stabilized with rip-rap and 270 feet (0.087 acre) of the proposed permanent access road will be placed below the Ordinary High Water Mark (OHWM) of the stream.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0030996), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Village of Philmont WWTP has a design flow of 0.25 mgd. Treatment consists of contact stabilization with aerobic digestion and settling. Dried sludge is landfilled. The facility has treated surface discharge to Claverack Creek, a class C(T) water.

The following changes to the permit are proposed: Permit pages have been updated based on current DEC guidance, format and nomenclature. Contact names, addresses and phone numbers have been updated. A definitions page has been added. Effluent limit for TKN has been removed; monitoring changed to seasonal. Effluent limit and seasonal monitoring for ammonia has been added. Footnotes have been adjusted. A monitoring locations map and an outfall location map has been added. Solids Wasting and Handling Plan has been added. Mercury Minimization Program has been added. Discharge Notification requirements has been added.
