Project Description:
DEC proposes to issue a new SPDES permit, pursuant to 6 NYCRR Part 750, for DOL Motor Pool Area V Industrial Wastewater Treatment Plant, Department of Defense - US Army Garrison West Point authorizing the discharge of wastewater to an unnamed intermittent stream tributary to Stillwell Lake (WIN H-61, Class A) The facility is considered a significant minor industrial facility, Discharge Class 01. The submission of a monthly Discharge Monitoring Report (DMR) is required. Based upon the review of the Industrial Application Form NY-2C submitted by the permittee and water quality based effluent limits provided by the Bureau of Water Assessment and Management, a SPDES permit has been drafted containing: Compliance Schedule for Water Treatment Chemical (WTC) The permittee intends to use Water Treatment Chemical (WTC). New or increased use of a WTC requires prior DEC review and authorization. At a minimum, the permittee must notify the DEC in writing of its intent to change WTC use. The DEC will review that submittal and determine if a formal SPDES permit modification is necessary or whether WTC review and authorization may proceed outside of the formal permit administrative process. Compliance Schedule for Short-Term High Intensity Monitoring Program A short term high intensity monitoring schedule for Surfactants (MBAS) and Cyanide have been added to the permit in order to have enough data to establish effluent limits. Sampling will be required once a week for a three month period to gather data to determine whether the pollutants are consistently present in the effluent and need to be limited.

Project Description:

The applicant proposes the construction of a new water filtration plant and approximately 5500 linear feet of water line connecting the filtration plant to the existing Consolidated Water District # 1 in the vicinity of the Jay Street and Katonah Avenue intersection. Fencing and fill associated with the stormwater management system for the plant will be located in the adjacent area of NYS freshwater wetland F-47 (Class 1). Portions of the water line will pass through the adjacent areas of wetlands F-72, F-46 and F55 (all Class 1) and will cross over New Croton Reservoir (AKA Muscoot Reservoir) NYS WIN # H-31-P44 (Class A) on an existing bridge. An additional 1465 linear feet of water line will be constructed to supply the plant with water from the New York City Delaware Aqueduct Shaft # 13.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Bedford Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Apr 22, 2010.
