Notice of Availability of Draft Scope for Comments

Project description and location:

This action involves a new ECL Article 19 Title V Air Facility Permit application from Albany Energy LLC, to construct a landfill gas to energy facility at the City of Albany Rapp Road Landfill and Solid Waste Management Facility. The facility is designed to recover methane gas generated from the landfill and use it as fuel to operate four (4) lean burn internal combustion engines which will produce electricity. The engines will be housed inside a building on the landfill property and the methane gas will be piped directly from the landfill's gas collection system to the generators. This proposed facility is being designed to beneficially use methane gas that is currently being burned in the Landfill's flares. The proposed facility will include installation and operation of a landfill gas treatment system that is dedicated to treating the landfill gas supplied to the engines installed for this project. Based upon the proposal by the applicant to hold a separate Air Title V permit for four new combustion engines, the current Title V permit held by the City of Albany, which covers the entire landfill and Solid Waste Management Facility, will need to be modified to allow this action. The project is located at the Albany Landfill at 525 Rapp Road, Albany, New York.

The New York State Department of Environmental Conservation (NYS DEC), as lead agency, determined that the proposed Albany Energy, LLC - Gas to Energy Facility may have a significant adverse impact on the environment and a supplement to the Environmental Impact Statement that was prepared for the Albany Landfill Expansion must be prepared. A SEQR Positive Declaration was published in the January 20, 2010 issue of the Environmental Notice Bulletin.

Opportunity for Public Comment:

A draft Scoping document has been prepared and is available for review at the NYS DEC - Region 4 Office address listed below, or may be obtained by e-mail. All persons who may have an interest in this project may provide comments on the draft scope by sending them to the attention of the NYS DEC contact person listed below.

All comments must be received by NYS DEC no later than 4:45 p.m. on April 30, 2010.

Negative Declaration

Delaware County - The Town of Colchester, as lead agency, has determined that the proposed LaMarch Campgrounds will not have a significant adverse environmental impact. The action involves the installation and construction of 10-14 new campsites, with utilities and bath facilities, including but not limited to two 750 gpd septic systems, electric and water and the installation of a 11 foot x 24 foot in-ground swimming pool. All facilities are to be in compliance with and under permit jurisdiction of New York State Department of Health (NYS DOH) Oneonta District Office and Code Enforcement of Town of Colchester, New York. The project is located at 634 Little Spring Brook Road in the Town of Colchester, New York.
