The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY-015-2161, DEC ID # 7-0332-00047/00001) for the Forest Manor MHP facility located in the Hamlet of Chenango Forks, Town of Fenton, Broome County, pursuant to 6NYCRR Part 750-1.18, under New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows: 1) Total Chlorine Residual limit has been changed from 2.0 to 0.45 mg/l; 2) Monitoring of Nitrite, Nitrate, Ammonia, TKN, Total Nitrogen and Phosphorus has been added to the permit for the NYS Tributary Strategy for Chesapeake Bay Watershed Restoration.

Project Description:

The applicant proposes to modify their existing Part 360 Solid Waste Management Permit for the AES Cayuga ash landfill. This involves a modification to the closure plans of the of the Phase II 1986 Expansion Area which includes a vertical expansion within the footprint of the Phase II 1986 Expansion Area, an area of 12.23 acres. The extent of vertical expansion over the sloped site is a maximum of 20 feet. The final elevation at the highest point will be lower than the height limit approved for the adjacent Phase II 1984 Expansion Area. AES submitted a Liner Demonstration Report to determine if the existing liner system is capable of meeting Part 360 standards for the proposed additional ash disposal. The Department has determined and affirmed the ability of the existing liner system to protect groundwater from contamination. Water quality monitoring will continue as required by Part 360. The expansion is necessary to extend the life of the landfill to accommodate coal ash produced by the AES Cayuga electric power generation facility nearby. AES Cayuga is also seeking alternative uses for the ash material which may reduce the volume of coal ash disposed of on-site and/or lengthen the life of the landfill.
