Section 401 - Clean Water Act Water Quality Certification

Project Description:

Installation of drain pipe and fill in the section of the Herkimer Hydraulic Canal running from E. German Street to NYS Route 5. The Canal will be cleaned of overgrowth and construction will take place without damage to the prisim of the canal. The sections specifically consist of 300 lineal feet of two (2) 36" CMP (North of E. German St) , 400 lineal feet of two (2) 48" CMP (between E. German & Suiter) and 500 lineal feet of one (1) 54" CMP plus installation of a 5.5' x 8' culvert (between Green & Folts). Also included is construction of a 27 space parking lot adjacent to Doxtater Street on Village owned property which will be maintained by the Village. A recreation trail with mini-park and landscaping will be constructed in the pipe & filled areas. The trail will be approximately 10 ft wide and will consist of geotexitle fabric and compacted stone dust. Three (3) signs intended to insure "...the public is educated about the history of the Herkimer Hydraulic Canal through images and text" will be installed as required by the NYS Office of Parks, Recreation and Historic Preservation. The draft design of the signs will be submitted to and approved by NYSOPRHP prior to installation. The US Army Corp of Engineers has issued a provisional Department of Army Nationwide Permit No. 39, Commercial and Institutional Development for this project.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received a request for a permit modification to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit Modification, for the facility located at Schuyler Wood Pellet LLC, Town of Schuyler in Herkimer County, New York. This facility is engaged in the manufacture of wood fuel pellets. The Standard Industrial Classification representative of this facility is 2499 (Wood Products). With respect to air pollution regulation, the activity of concern at SWP is the by-products of wood fuel combustion and wood particulate emissions.

The original Permit was configured to be a permit to construct and therefore had been earmarked for modification after 180 days of plant operation. SWP is requesting to modify its permit to delete sources and emission points that were never installed, to add emission points and to update its emission point parameters and also its emissions summary data.

The facility has capped potential carbon monoxide at level that is below the major source threshold. The main combustion furnace has been required to undergo a repetitive stack test at five year intervals. The tests will be for carbon monoxide, NOx, VOC and for particulates. This new testing regime will verify that this facility's emissions continue to elute within the Regulatory Standards of this modification.

The draft permit with all conditions is available for review in the Region 6 NYSDEC Sub-Office in Utica, NY.

Project Description:

The applicant proposes to develop a new gravel mine on 1.6 acres located on a 52.70 acre parcel owned by Benjamin Mangan, 32258 Middle Road, Carthage, New York 13619. The site is located approximately 800' south of Middle Road, 1,000' east of Switzer Road, two miles west of the Jefferson/Lewis County line. Gravel will be used for Town road projects. On site screening will take place, and mining will take place below the water table.
