Project Description:

The applicant proposes a discharge of up to 65,000 gallons per day of treated sanitary wastewater to Library Brook (a Class D waterbody that is tributary to Lake Champlain) from a new municipal treatment plant at the applicant's facility located at NYS Route 22, Town of Essex. The applicant plans to construct a new municipal community sewerage system, including: Gravity sewers and three pump stations; preliminary treatment consisting of fine mechanical bar screen and Vortex grit system; wastewater will be pumped to a new 2-basin Sequencing Batch Reactor (SBR) wastewater treatment system equipped with aeration, mixing and anoxic zones for BOD and biological phosphorus removal; chemical phosphorus removal; and year-round effluent UV disinfection; and sludge handling and disposal through aerobic digestion and sludge reed beds.

Total Phosphorus (TP) allocation of 0.27 lb/day has been established for this project. This new TP waste load allocation was obtained by adjusting the remaining 2.00 lb/day within the same lake segment. The remaining allocation of 1.73 lb/day will be provided to the Willsboro Sewer District #1 WWTP SPDES No NY-023 9682).

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination in accordance with its Environmental Benefit Permit Strategy to modify the State Pollutant Discharge Elimination System (SPDES) permit for the Willsboro Sewer District No. 1 Wastewater Treatment Plant. The existing permitted facility is a secondary treatment plant located at 76 Gilliland Lane in Willsboro, with a design flow discharge of 75,000 gallons per day of sanitary wastewater to the Boquet River, a Class C(T) stream. The permit is being modified to add an effluent limit for phosphorus (1.73 lbs/day, 12 month rolling average) in accordance with the Lake Champlain phosphorus Total Maximum Daily Load (TMDL) limit requirement. Other proposed modifications include: Flow limit reduction from 125,000 gpd to 75,000 gpd; new sampling location as a result of newly Constructed Wetland Treatment System; and other minor changes related to the use of this new wetland treatment system and the reduced design flow.

This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The draft permit (SPDES #NY-023 9682) is available for review by making an appointment with the contact person listed below.
