ENB - Region 5 Notices 03/24/2010
Proposed General Permit
New York State Department of Environmental Conservation (NYS DEC) - Region 5 proposes to modify and re-issue General Permit 5-08-001 (GP) for the minor activity of temporary stream crossings for logging activities, regulated under Environmental Conservation Law (ECL) Article 15, Title 5 (Protection of Waters). The modification to the GP consists of adding the authorization to utilize existing fords, and alter the transaction mechanism to improve turn-around times. In addition to existing fords, the re-issued GP will continue to authorize the temporary placement, construction, maintenance and removal of culverts and bank-to-bank bridges, for the expressed purpose of crossing regulated non-navigable streams during the conduct of logging activities. Staff has concluded that there will be no significant environmental impact to the Region 5's aquatic resources when the activities are conducted in accordance with the terms and conditions contained in the GP, which have been standardized to improve natural resources compliance, protection and enforcement. No other changes are proposed. A State Environmental Quality Review (SEQR) Negative Declaration has been prepared and is on file.
Comments will be accepted until April 23, 2010.
