Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve the application to renew and modify the Title V permit for this facility. The modification consists of adding conditions recently promulgated under regulations 6 NYCRR Parts 243, 244, and 245. These regulations require facilities to obtain/possess at least as many 'allocations' of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. An 'allocation' is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency's (EPA's) recent "Clean Air Interstate Rule" (CAIR). The regulations are included in New York's ' State Implementation Plan' (SIP) which has been approved by EPA as required by the Clean Air Act of 1990.

The facility is a cogeneration plant consisting of one gas turbine and heat recovery steam generator with a duct burner, and three auxiliary boilers. All units fire on both natural gas and Number 2 fuel oil.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant proposes to stabilize 150 feet of the southern shoreline of Avon Lake, a NYS regulated Freshwater Wetland (#A-4). Shoreline stabilization will include installation of coir logs and erosion control blankets (both made of biodegradable coconut fibers) held in place with wood stakes, supplemented with rocks one foot in diameter as needed on the lake side.
