Project Location: The site is an approximately 12.5 acre parcel of land in the Whitestone section of Queens, New York. The site has a street address of 151-45 6th Road, Whitestone, New York, 11357 and is identified as the following lots and blocks: Block 4487, Lots 160, 169, 170 and 200; Block 4524, Lots 77 and 92; and, Block 4531, Lots 79 and 92. The site was historically occupied by residential houses, a park/pavilion recreation area, a restaurant, a metal shop, a boat manufacturer, a shooting range and shop until circa 1950. An asphalt plant operated at the site from approximately 1952 through 1992.

Project Description: The objective of the Remedial Action is to address contamination at the site which occurred due to leaking storage tanks as well as historic fill. The Volunteer has submitted a Remedial Work Plan (RWP) for the remediation of the soil at the site. The planned remedial activities are described in the RWP which is now available for public review.

Comment Period: The RWP is available for review at the location identified below. Written comments on this plan must be received within 45 days of this Notice. Written comments expressing objection or opposition to the project must explain the basis of that opposition and identify specific grounds which justify New York State Department of Environmental Conservation (NYS DEC) imposing significant changes to the work plan. No formal response is made to comments received, but, as a result of comments, NYS DEC may re-evaluate and revise the work plan.

Negative Declaration

Kings County (Manhattan) - The New York City Planning Commission, as lead agency, has determined that the proposed 401 Washington Street will not have a significant adverse environmental impact. The action involves a proposal by the applicant to convert the existing six story warehouse building to a 58,503 gross square foot residential building (floors two through six) with approximately 5,327 gross square feet of limited as-of-right retail use at the ground floor. The proposed actions would also facilitate the addition of a 5,067 gross square foot penthouse to the existing structure resulting in 35 total dwelling units. The project is located at 401 - 411 Washington Street in the Manhattan Community District 1, New York.

Conditioned Negative Declaration

Queens County (Queens) - The New York City Planning Commission, as lead agency, has determined that the proposed Elmhurst Zoning Map Change will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves a proposal by the co-applicants, 45-10 94th Street LLC and 91st Place Realty, LLC, for an amendment to the Zoning Map to rezone a portion of a block from an M1-1 zoning district to an R7B zoning district. A C2-3 zoning district would also be mapped at a depth of 100 feet along Corona Avenue between 94th Street and 91st Place.

The proposed rezoning would facilitate a proposal by the applicant to redevelop a 58,313 square foot parcel with a mixed use development consisting of three buildings and containing approximately 120 dwelling units; 7,500 square feet of ground floor commercial space; and approximately 60 accessory parking spaces, 36 of which would be located in the cellar floor of the largest building and 24 would be in on-site parking lots. The site is currently developed with one story brick shipping warehouse which would be demolished. The project is located on a portion of a block bounded by 91st Place to the west, Corona Avenue to the south, the Long Island Railroad viaduct to the north, and 94th Street to the east in the Elmhurst section of Queens, Community District 4, New York.

The conditions are: The proposed rezoning includes an (E) designation (E-248) for hazardous materials, air quality, and noise. The placement of the (E) designation would eliminate the potential for significant adverse impacts related to hazardous materials, air quality, and noise on those sites.

With the implementation of the above (E) designation, no significant adverse impacts related to air quality would occur.

The applicant, 45-10 94th Street LLC, and 91st Place Realty, LLC, agrees via a restrictive declaration to prepare a hazardous materials sampling protocol including a health and safety plan, which would be submitted to the New York City Department of Environmental Protection (NYC DEP) for approval. The applicant agrees to test and identify any potential hazardous material impact pursuant to the approved sampling protocol and, if any such impact is found, submit a hazardous material remediation plan including a health and safety plan to NYC DEP for approval. If necessary, remediation measures would be undertaken pursuant to the remediation plan.
