Project Description:

The applicant proposes to add 4 acres of land to the presently permitted 24.1 acre sand and gravel pit. The expansion area consists of 3 acres owned by James Gravel Products, LLC, and 1 acre owned by Harold Luce. No other changes are proposed to the existing Mined Land Reclamation permitted facility, including the reclamation objective (agriculture and vegetated slopes). The existing mine is located west of Chautauqua County Route 49 and north of Chautauqua County Route 28/Busti-Stillwater Road, in the Town of Kiantone, Chautauqua County. The expansion area is adjacent to the land currently permitted for mining, and to the east of the current northeast life-of-mine boundary.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has drafted a permit and made a tentative determination to approve this application for renewal of SPDES Permit No. NY-0170861 for an existing discharge of up to 42,000 gallons per day of treated sanitary wastewater from an extended aeration/sand filter system to Crooked Brook. The applicant operates a mobile home park located at 3742 East Main Road (Rt. 20) in the Town of Pomfret.

Project Description:

Restoration and stabilization of approximately 280 feet of an embankment along the South Branch of Eighteen Mile Creek. A mechanically stabilized earth wall will be constructed to retain the upper portion of the slope. The slope below the wall will be flattened to 1 vertical:2 horizontal and the toe will be protected by a doweled, stacked rock wall and heavy stone fill.
