Project Description:

The Department has received an application to establish emission reduction credits for the Norbord Industries facility located on Laurel Bank Avenue, Town of Deposit, County of Delaware, owned by Norbord Industries, Inc. of Deposit, New York. The facility produced medium density fiberboard (MDF) used by the furniture industry as a core material. The facility included boilers, presses, dryer, raw material handling sources and other miscellaneous sources. The facility has ceased operations and surrendered their Title V permit. The permittee is proposing to establish certified emission reduction credits for the emission reductions resulting from the shutdown of all of the emission sources at the facility. Norbord Industries, Inc. will be establishing emission reduction credits of 178.24 tons of oxides of nitrogen (NOx) and 15.56 tons of volatile organic compounds (VOC) in accordance with 6 NYCRR Part 231-10 Emission Reduction Credits (ERCs) with this permit modification.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a legislative hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exists. A copy of the Department's permit hearing procedures is available upon request or on the Department's web site at: http://www.dec.ny.gov/permits/6234.html.

Project Description:

The applicant proposes to modify an existing State Pollutant Discharge Elimination System (SPDES) permit to change sampling requirements to once per month as reflected on prior permits. A schedule of compliance is also being added to the current permit. The facility is located at 89 Potic Creek Road in the Village of Catskill. The Department has made a tentative dtermination to issue a permit for a State Pollutant Discharge Elmination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought or for the overall project. A draft permit is available for inspection and comment at the Region 4 office.
