Project Description:

This Department has received a request to modify a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at Burrstone Energy Center CHP Plant, 1656 Chaplin Ave; New Hartford, NY 13502. This facility will produce electricity, and steam for nearby facilities.

The Department has made a tentative determination to approve the application of Burrstone Energy Center CHP Plant's Air State Facility Permit. The modification to the permit was requested since the facility has determined their operation under their current Air State Facility Permit required changes in order to meet the electricity, and steam needs of the associated facilities. This modification allows the installation of emission control equipment to the operations of emission unit 0-00001, which includes the operation of four internal combustion engines connected to electric generators to produce electricity for St. Luke's Hospital, St. Luke's Home, and Utica College. The operation also includes four heat recovery units that utilize the heat from the engine exhaust to produce steam for heating and other requirements at the facilities. The control equipment will be installed on two of the engine exhausts. The facility has capped out of Title V Permitting requirements by tracking and restricting it's emissions of Carbon Monoxide to below emission levels of 100 tons per year, and formaldehyde to levels below 10 tons per year.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 26, 2010.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0236586), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Canton Water Pollution Control Plant has a design flow of 4.2mgd. Treatment consists of a collection system, bar racks, aerated lagoons and seasonal dechlorination. The facility has treated surface discharge to the Grassee River, a Class B water.

The following changes to the permit are proposed: Total Suspended Solid limits of 30/45mgl 30 day avg/7 day are are applicable thoughout the year. Discharge Notification Requirements have been added. A schedule of compliance has been added for copper, total; zinc, total; arsenic, total; and phenols, total.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
